Terms and Conditions

Welcome to Carey (“Carey,” “Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our healthcare and caregiving AI assistant (“Service”). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy here.

If you do not agree to these Terms, do not use the Service.

1. Company Information

New Innovation Services d.b.a.”Carey” is operated by a company registered in the State of California and headquartered in the Bay Area, California. These Terms apply to users located within the United States. The Service is not intended for use outside the U.S. or by individuals subject to foreign privacy laws such as GDPR.

2. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use the Service. By using the Service, you represent and warrant that you meet these requirements and that you are using the Service within the United States.

3. No Medical Advice

The information provided by Carey is for informational and educational purposes only and is not medical advice. Carey is not a licensed medical provider. Always consult a physician or other qualified healthcare provider regarding any medical concerns or conditions.

Do not disregard or delay seeking medical advice because of something you read or receive via the Service.

4. User Accounts

To access some features of the Service, you may need to create an account. You agree to provide accurate and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You agree to notify us immediately if you suspect unauthorized use of your account.

5. Permitted Use

You agree to use the Service only for lawful and intended purposes. You may not:

  • Use the Service to collect or transmit unlawful or harmful content;
  • Access the Service using automated means (bots, crawlers, etc.);
  • Interfere with or disrupt the functionality or security of the Service;
  • Attempt to reverse engineer or replicate the AI technology.
  • Attempt to access data, information, metadata or logs relating to someone else or someone else's use of the service

We reserve the right to suspend or terminate your account for any violation of these Terms.

6. Data Collection and Use

When you use Carey, we collect, process, and store data as described in our Privacy Policy here. This includes:

  • Personal Information (e.g., name, email, phone number)
  • Information from Google services if you choose to connect them (e.g., email and name from Google Sign-In, calendar availability from Google Calendar — see Section 8.1)
  • Health-related data you voluntarily provide or approve our access to (e.g., symptoms, caregiving preferences, conditions)
  • Device & Usage Data (e.g., browser type, IP address, interaction logs)

We use this data to:

  • Deliver personalized and contextually relevant responses;
  • Improve our AI systems and performance;
  • Support operational, legal, and product development functions.

6.1 Anonymized Data Sharing

We may share anonymized and aggregated data, which cannot reasonably be used to identify you, with trusted partners, vendors, researchers, or for analytics and product development purposes. This data is stripped of direct identifiers and handled according to industry privacy and security standards.

7. HIPAA and Health Information

Carey is not a covered entity under the Health Insurance Portability and Accountability Act (HIPAA). However, we are committed to maintaining high standards of data privacy and security and may enter into Business Associate Agreements (BAAs) with third parties when required.

8. Third-Party Services

Our Service may link to or rely on third-party platforms or tools. We are not responsible for the content, terms, or privacy practices of those services. Any use of third-party services is subject to their respective terms and policies.

8.1 Google Services Integration

Carey integrates with certain Google services to enhance your experience:

Google Sign-In: If you choose to sign in using your Google account, you will be asked to grant Carey permission to access your email address and name for authentication purposes.

Google Calendar: If you choose to connect your Google Calendar, you will be asked to grant Carey permission to read your calendar(s), in order to determine free/busy availability to help schedule appointments without conflicts.

By connecting these Google services to Carey, you also agree to be bound by Google's Terms of Service and Privacy Policy.

Carey's use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. For detailed information about how we handle Google user data, please see Section 10.1 of our Privacy Policy.

Revoking Access: You may revoke Carey's access to your Google Calendar at any time through Carey's application, or via your Google Account permissions directly. To revoke Google Sign-In access, you will need to remove Carey from your Google Account permissions directly.

9. Intellectual Property

All content and functionality within the Service, including but not limited to software, text, AI models, graphics, logos, and user interface elements are the exclusive property of Carey or its licensors. You may not copy, modify, distribute, or reverse engineer any part of the Service without prior written permission.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” CAREY MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, error-free, or that any health-related suggestions are clinically validated or applicable to your situation.

11. Limitation of Liability

To the fullest extent permitted by law, Carey and its affiliates, directors, officers, employees, and licensors will not be liable for any indirect, incidental, consequential, punitive, or special damages, or for any loss of profits, data, or revenue, arising from your use of the Service.

Our total liability for any claim arising out of or relating to the Service shall not exceed the greater of (i) the amount you paid to use the Service in the 12 months prior to the event or (ii) $100.

12. Indemnification

You agree to indemnify and hold harmless Carey and its affiliates, officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Service or violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time for any reason, including suspected violations of these Terms. Upon termination, your right to use the Service will cease, but provisions related to intellectual property, data, disclaimers, and liability limitations will survive.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict of laws principles. You agree that any legal action or proceeding shall be subject to binding arbitration in accordance with the rules of the American Arbitration Association (AAA), conducted in San Francisco County, California.

You waive your right to a jury trial or to participate in class actions.

15. Changes to Terms

We may revise these Terms from time to time. We will notify users of material changes by posting an update within the app or via a message to the user via SMS, email, or other means. Continued use of the Service after such changes constitutes your acceptance of the updated Terms.
